you're not wrong about that..
but over the years no one cares and this rule got buried with other rules along with the developers of this game.

 And when they are found to be named for sale, the name is removed. Also, if you buy an account, you inherit the user's prior sanctions. Furthermore, many players find that they cannot change the original email used to open the account and after buying the account, the prior user either sells the account again to someone else or just takes it back via the password reset. Fiscals will not get involved in settling any disputes.

So buyer beware, there are multiple ways for your new *bought* account to get removed.
