So finding a gem at a garage sale on direct buy is viewed as illegal. With no questions as to the circumstances, you are punished straightaway.

You can only appeal, and if it is *very* compelling, they *might* mitigate the fine...this doesn't happen very often, no matter how good the evidence in your favor. The person you are appealing to is the person who levied the fine. So they are both the prosecutor and the appellate judge.

I disagree with this practice and procedure, in any case.

Direct buys are largely circumstantial... there is no cut and dry way to tell if they were treated as a transfer agreement, or someone noticing a good deal and seeing it first. BUT they are treated as cut and dry.
